A Rochester father who previously pleaded guilty in connection to an accidental shooting death of his 2-year-old son will spend less time in prison after Friday's ruling by a Monroe County Court judge.

Charles Timothy Phillips, 36, appeared in Justice John Demarco's courtroom Friday where he was scheduled to be sentenced to a 12-year prison term.

Phillips accepted a plea agreement last month in which he pleaded guilty to criminal possession of a weapon. The previously convicted felon admitted to leaving a loaded illegal handgun unattended when his son, Zayden, grabbed the weapon and shot himself in the head. At sentencing, DeMarco allowed Phillips to withdraw his original plea and then enter a new guilty plea to second degree manslaughter.

Phillips was sentenced to 9 years in prison.
