ROCHESTER, N.Y. -- There's more legal problems for Rochester City Court Judge Leticia Astacio as she may have violated the terms of her conditional release on a DWI conviction.

As part of her August sentencing, she was required to have an interlock ignition device on her vehicle for a year.  

Her lawyer, Ed Fiandach, said last month his client blew above .05 and she asked her daughter to unlock the device and drive the car home.

The judge appeared in court on Tuesday to answer to the new accusations.

Fiandach also says it's also not clear that Astacio's conditional release prohibited any alcohol consumption during that period.

She is expected back in court on Nov. 16.
