The former Pittsford man who had a murder charge dismissed in the killing of his father will remain jailed until his trial on weapons charges. 

A bail hearing for Charlie Tan scheduled for Thursday has been waived by his attorney. 

Brian DeCarolis says he and Tan called off the hearing because Tan would have remained in custody even if he had been granted bail. 

DeCarolis says that's because Tan is a Canadian citizen and would have been held on an immigration detainer even if granted bail on the weapons charges.  

Tan was arrested last month as he tried to cross the border from Canada to the U.S. in Niagara County. 

His arrest is in relation to the 12-gauge shotgun and ammunition prosecutors say were used in the killing of his father, Jim Tan, back in February 2015. 

The indictment accuses Tan of coercing a friend to purchase the gun from a Cortland County Wal-Mart. 

That friend has never been charged.

The exact date of Tan's trial isn't known, but DeCarolis believes it will be sometime in late November.
