An elementary school teacher from North Syracuse schools is heading to trial.

James Ball is accused of shooting and killing his brother-in-law on the Fourth of July.

Investigators say the two men got into a fight prior to the shooting.

Ball allegedly fired four shots from a 22-caliber rifle. Two of those bullets hit 40-year-old Christopher Ross in the back.

His trial date has been set for September 10th.

He is charged with second degree murder and first degree manslaughter.

Despite his reputation as a well-respected teacher at Smith Road Elementary School, the District Attorney’s office says the evidence justifies the murder charge Ball is facing.

It’s unclear whether a plea deal is under consideration.

"He's got a great support system out there.  You can tell he's a very well respected man in this community, and he has been for a long time," said Michael Spano, his attorney.

"We will look at every aspect of this case.  We will review every piece of evidence and we'll entertain any information that we can get regarding all the parties involved," said Michael Kasmarek, a senior assistant DA.
