Michael Carr, accused of causing a car crash last year that resulted in a fire at Blessings Tavern in Colonie and leaving a 16-year-old friend badly burned, is now in Albany County jail because he violated the terms of his release.
A source tells Spectrum News that Carr had two encounters with police -- one for underage drinking and another for overdosing on Xanax. He’s been back in custody since December 1.
Carr is accused of being on drugs when he crashed his car into Blessings Tavern in Colonie last October. The vehicle and restaurant burst into flames, and the passenger in the car, Niko DiNovo, suffered burns to 95 percent of his body.
Carr is facing vehicular assault, reckless endangerment and driving while ability impaired by drugs. Carr had been released by an Albany County judge last November under the supervision of the Albany County Probation Department.
The two encounters he had with police violated those terms, and that’s why he’s back behind bars.
The Albany County District Attorney’s Office says his trial is scheduled to begin January 8.
DiNovo is still making progress in his recovery at Westchester Medical Center and continues to work with physical therapy specialists to gain strength and mobility.
