The man convicted of sexually assaulting and murdering a young boy is not getting a new trial.

The State Supreme Court’s appellate division denied a request from Matthew Kuzdzal, convicted of assaulting and killing his girlfriend’s 5-year-old son in 2013. Kuzdzal was babysitting Eian Brooks at the time.

His conviction was vacated after someone accused a juror of bias, but on Friday, the court decided the allegation was not credible.  

Kuzdzal remains in prison, serving a sentence of 50 years to life behind bars.
