BEXAR COUNTY, Texas - A family whose home was mistakenly raided by police in November has filed a lawsuit against the Bexar County Sheriff’s Office and the Texas Department of Public Safety.

According to the lawsuit, about 3 p.m. on November 14, 2018, plaintiff Lucil Basco was driving on Bandera Road en route to pick her child up from school when she was pulled over by police.

Following a search of her vehicle, she received a warning ticket for failing to use her turn signal, having an obstructed plate and failing to pull over immediately. Basco, in the lawsuit, said she did not agree with those accusations.

Basco then continued on to pick up her son and returned to her home in Leon Valley.

While watching TV with her son, about 4:15 p.m. that day, Basco heard a loud banging sound. Her front door was forced open, the lawsuit states. Basco’s husband was at work at the time of the raid. Several officers and deputies entered the home, and Basco was placed in handcuffs. The lawsuit claims that during the search of the home, a bedroom and a closet door were broken.

“I was shocked," Basco said. "How could this happen to my family? I am a nurse. I spend my days helping people.”

Basco was presented with a warrant, which cited information from a “John Doe” confidential informant. The lawsuit states that the warrant was signed at 3:42 p.m., after the traffic stop on the plaintiff, and served at 4:20 p.m., after the raid on the home had begun.

The next day, one of the defendants told Basco that the raid was a mistake, according to the lawsuit. The lawsuit further states that Basco was told she would receive payment for the broken doors but has yet to be compensated.

The lawsuit seeks a jury trial and compensatory damages as well as attorney fees.

Spectrum News reached out to the Bexar County Sheriff’s Office and the Department of Public Safety for comment. BCSO sent us the following statement:

We have not been served with any legal process. We will defer to the District Attorney’s Office regarding any ongoing legal matters.”

We have yet to hear back from the other agency contacted.
