AUSTIN, Texas -- A Texas appeals court has delayed the execution of a death row inmate over concerns about evidence collected in the case.

• Man convicted of killing girlfriend's 13-month-old daughter 
• Couple said homicide happened during "exorcism"
• Attorneys say intellectual disability makes him ineligible for execution

The East Texas man was convicted of killing his girlfriend's 13-month-old daughter during what the couple called an "exorcism."

Blaine Milam's attorneys argue the bite mark evidence used for a conviction is "now discredited."  They also say his intellectual disability makes him ineligible for execution.

His girlfriend was also convicted of capital murder and sentenced to life in prison without parole.
