AUSTIN, Texas - Travis County District Attorney Margaret Moore Tuesday reported her office has concluded its review of the Austin Police Department’s investigation into a May 7, 2017, officer-involved shooting.

In a statement, Moore said the shooting death of Landon Nobles by Sgt. Richard Egal and Cpl. Max Johnson of the Austin Police Department was justified.

Moore said that per policy, she will not present the case to a grand jury for possible indictment.

According to officers, about 2:39 a.m. on May 7, 2017, officers in the area of Trinity and 6th streets heard a gunshot ring out nearby. There was a disturbance in front of the Moose Knuckle Pub nightclub, and a woman who was running told the officers a man had fired a gun in the air.

The witness provided a description of the man who fired the shot, and those officers located a man matching that description nearby. That man was 24-year-old Nobles.

Nobles ran, and Egal, who was on bicycle patrol, caused Nobles to fall to the ground. Police said Nobles got up and continued to run. While running, police said, Nobles turned toward officers while holding a handgun.

The officers perceived the action as an imminent and deadly threat and opened fire on Nobles, striking him three times. The gun in Nobles’s possession was found to be fully functioning, according to officers.
