AUSTIN, Texas — Austin police have arrested an 18-year-old accused of shooting a security guard after being kicked out of the Sigma Chi fraternity house near the University of Texas campus on Sunday.

According to an arrest affidavit, Daniel Hamilton Magee expressed interest in joining the organization before the incident.

Magee was booked into the Travis County Jail on Monday morning and charged with aggravated assault with a deadly weapon.

He attended a party at the house in the 2100 block of Nueces Street around 3 a.m. following the UT football game, the affidavit says. 

In the report, members of the fraternity asked an on-site security guard named Edward Earls to kick Magee out because he was causing issues. 

“Magee became upset and had to be physically removed by Earls,” the document said. “When Magee got to the front gate of the fraternity house Magee made verbal threats to return to the party with an AK-47 rifle and shoot up the place.”

Magee returned with two others approximately 45 minutes later and witnesses told investigators one of the men pulled out a gun, fired one round at Earls and struck him in the foot.

There is no mention of the 2 men with Magee when the shooting happened in the arrest affidavit.
