Arguments are scheduled for March 1 in a high-profile murder case in Monroe County.

Attorneys will debate whether a judge rightly or wrongly threw out a murder charge against Charlie Tan.

Those arguments will be heard before the State Supreme court Appellate Division.

The District Attorney's Office contends Judge James Piampiano erred when he ruled there was not enough evidence to support the criminal charges against Tan.

Tan is a former class president at Pittsford Mendon High School and was a 19-year-old student at Cornell University when he was charged with killing his father, Jim Tan, in February 2015.

A mistrial had been declared after jurors in the case were unable to reach a verdict.

In August, the District Attorney's Office appealed the judge's ruling.
