CINCINNATI — The man accused of running down a deputy after police shot and killed his son faced a judge Wednesday.

Rodney Hinton Jr.'s hearing happened less than 24 hours after his son’s death was ruled justified.

At the courthouse Wednesday, Hinton Jr. came into the courtroom with little expression.

Clyde Bennett, Hinton Jr.’s defense attorney, said Hinton Jr. was in court unaware of Tuesday’s findings.

“I haven’t discussed that with him because I don’t wanna facilitate or precipitate any other thing happening," Bennett said.

Hinton Jr. is charged with killing Hamilton County Deputy Larry Henderson. Prosecutors say he purposely ran the deputy over after watching body camera video of his son, Ryan Hinton, who was shot and killed by Cincinnati Police.

The Hamilton County prosecutor ruled that shooting justified Tuesday.

Hinton Jr.'s defense says he has a mental illness.

“I think he still has the residual effects from a psychotic episode, so he’s not 100%," Bennett said.

There was no ruling in court Wednesday, but there were multiple motions filed by the defense to take the next steps.

“The next step is to gather all of the evidence, and most of that's going to have to come from the state of Ohio, particularly the audio and video recordings of the defendant before and after this happened, while he was transported to the hospital, back and forth to the jail," Bennett said. "I think that documents, memorializes, his mental state. The video and audio recordings, when he met with the police and was shown the video of his son being slaughtered, all of that is all recorded. We need that information, and I should have that information in the next two weeks.”

A second attorney was also recently added to the defense, because Hinton Jr. could be facing the death penalty. The next pre-trial hearing for Hinton Jr. is July 9.
