A two-part HBO documentary airing Tuesday and Wednesday questions the prosecution of the Garrett Phillips case. The documentary seems to suggest that the trial of "Oral" Nick Hillary was driven by racism. 

Hillary was accused of killing 12-year-old Garrett Phillips, and tried five years following Phillips' murder. The lead prosecutor in the trial was Onondaga County District Attorney William Fitzpatrick.

Airing Tuesday at 8 p.m., the documentary seems to allege that the investigation, arrest and trial of Phillips was on the basis of race. DA Fitzpatrick says he spoke with producers of the documentary before the trial began and he believes the team drew its own conclusions before the trial even began.

"You keep saying it, you keep saying it and then all of a sudden it's a given and then I'm supposed to spare the burden of proof to prove that it wasn't despite the fact that there wasn't a scintilla of evidence to show that anything that I said or did indicating any racial amethyst whatsoever," said Fitzpatrick.

Hillary was found not guilty in 2016.​ The two-part documentary airs at 8 p.m. both Tuesday and Wednesday night.
