A fourth-grader from the Rochester City School District has been home from school this week, recovering from injuries the family claims came when she was assaulted by a school bus driver.

Leila Shaughnessy, 9, attends School 52 in Rochester, and says her ride to school can be noisy.

"Normally it's loud, but everybody's like sitting down. They're not standing up, it's just kind of a normal bus ride," said Leila.

But on Monday, Leila said that was not the case, as a substitute driver stopped the bus, angry over the noise.

"She yelled at the whole bus to shut up. And I just kinda went like this because normally it's be quiet," said Leila.

Leila explained the driver then told her to move to the front of the bus.

"She forcefully came and did full arm, like that to me and I fell backwards and I hit my head," said Leila.

Once Leila arrived at school, her mother, Amber Goodnight, said she received a phone call from the school nurse. Goodnight says she took her daughter immediately to the hospital where tests showed Leila had suffered a concussion.

"I was very upset. I felt angry, I felt, at first I was kind of confused, I didn't know like, how could something like this happen," said Goodnight.

The Rochester Police Department confirmed a report was filed and an investigation into the alleged assault is underway.

First Student issued a statement, saying in part, "First Student is partnering with local authorities for their investigation of the matter... we also are conducting our own internal review. Consistent with our standard process, the driver was immediately removed from the route pending the outcome of the investigation."

Goodnight has demanded that First Student provide a video from the bus camera.

"I'm probably not going to trust my children on the bus anymore until First Student takes accountability and shows me that they are doing the proper steps," said Goodnight.

Leila is expected to return to school next Monday.

"I'm hopeful that this never happens to another kid ever again," said Leila.
