The Monroe County District Attorney's Office confirmed it is convening a grand jury to examine the evidence and determine if any criminal charges should be filed after a city man was injured.

Officers Spenser McAvoy and Michael Sippel are currently suspended without pay as the department looks into allegations they used excessive force and unlawfully arrested Christopher Pate on Fulton Avenue in May.

According to Pate's complaint, his backpack was ripped off, he was tased and punched in the face while in handcuffs.

The report filed by Officer McAvoy states that he did not turn his body camera on when he stopped the 37-year-old man.

There's no word on a time table for when that grand jury will get to see that evidence.
