The Livingston County man accused of being involved in a hit-and-run crash which killed a Rochester toddler was arraigned on Tuesday. 

Frank Cassata, 48, is charged with second degree murder, vehicular manslaughter, leaving the scene of an accident resulting in death and drunk driving. He pleaded not guilty in Monroe County Court.

And an order of protection was issued for Cassata's girlfriend. Prosecutors say it's because she is a potential witness in the case.

Police say Cassata got into an argument on June 2nd with a group of people on Lyell Avenue in Rochester.

He's accused of intentionally driving his car off the road in an effort to run over a man, but instead hitting and killing 3-year-old Amir Pallet. Cassata remains in jail without bail. 

Cassata is no stranger to the criminal justice system. He previously served more than ten years in state prison. 

He was first convicted in 2000 of attempted criminal possession of a forged instrument. He served three years and was released. 

In 2005 Cassata was found guilty of first degree robbery and burglary.  He served eight years for that conviction and was placed on parole, which ended in October.
