A judge has denied asylum for Abigail Hernandez, the former Rochester City School District student who made terroristic threats against East High School.

In her hearing Friday, the judge odered that she return to Mexico.

Hernandez's defense attorney plans to appeal the ruling and she'll remain in the United States in the meantime.

 

 

That application must be in by December 3. 

Hernandez' family told the court they feared there is no one to care for her back in Mexico.

Her defense team asked that she be given asylum because of her intellectual challenges. 

Hernandez has already been sentenced to three years probation for threatening to shoot up east high school in February.
