ROCHESTER, N.Y. — A Monroe County Court Judge has reversed the conviction of a man accused of shooting at a Rochester police officer back in 2016.

Judge Christopher Ciaccio overturned the criminal weapons possession charge against 36-year-old Silvon Simmons, saying shot-spotter provided incomplete evidence, hindering the case.

Simmons was accused of firing at officer Joseph Ferrigno on Immel Street on April 1, 2016. 

The exchange of gunfire came as officers approached a suspicious vehicle.

Police say Ferrigno returned fire, hitting Simmons three times. He later recovered.

The Monroe County District Attorney's office says it plans to appeal the ruling.
