An Ulster County man who beat his father to death with a baseball bat in 2014, lost his appeal of a second-degree murder conviction. 

Nicholas Pascarella Junior had his conviction upheld unanimously by New York's Appellate Division, Third Department, with this news coming from the county DA on Thursday.

Pascarella was convicted in December 2016 after his second trial — his first was declared a mistrial over a deadlocked jury.

The defense had argued Pascarella was under extreme emotional disturbance, believing his 66-year-old father was abusing another family member, after having sexually abused Pascarella as a child.

The DA says the failed appeal centered on the jury not accepting that defense, as well issues with his legal counsel and sentence.

Pascarella was sentenced to 25 years to life in prison.
