A Utica common councilman is facing misdemeanor charges related to a July DWI arrest.
Delvin Moody, 24, was elected last year.
State police say Moody was arrested and charged in the early morning hours of July 17 in Rome.
Troopers approached his vehicle on the side of the road. It had two flat tires. They say Moody was sleeping.
Troopers smelled alcohol, and Moody's BAC was .11.
Moody's license had been suspended, and he was charged with DWI and third-degree aggravated unlicensed operation.
Moody says public safety, accountability, and transparency are values he holds dearly.
His attorney has asked him not to comment since the case is still in court.
He adds that, "as a young public figure, I realize that I will make mistakes and I will own the things that I've done wrong and will work to be better. I have dedicated my entire life to service and will remain focused on that mission. As a person of faith, I know that people grow. I certainly have, both as a leader, official, and community servant."
