New York state is blocking dozens of law enforcement agencies' access to digital Department of Motor Vehicles records in accordance with the state's new Green Light Law.
The law grants undocumented immigrants the right to apply for driver's licenses but it also has strict stipulations on privacy and information sharing with the federal government. A spokesperson for the Division of Criminal Justice Services confirmed law enforcement agencies were supposed to sign an agreement by Saturday, January 11, certifying they would not share data with immigration enforcement agencies like ICE and Customs and Border Protection.
CNHI first reported Monday night 78 agencies had been blocked from the record system known as DMV Photo. As of Tuesday afternoon that number had dwindled to 59 and Criminal Justice Services says it continues to receive agreements.
The spokesperson did not provide a list of agencies who have not turned in the agreement yet. Under the Green Light Law, immigration enforcement can only gain access if it submits a court order, subpoena, or judicial warrant to DMV.
The Erie County Sheriff's Office said after reviewing the agency's options and considering officer and public safety, it signed the agreement to maintain access to the DMV database.
