Former Gov. Andrew Cuomo's court date on a charge of forcible touching is still on for Friday as Albany County District Attorney David Soares is moving to have the case dropped. 

Office of Court Administration spokesman Lucian Chalfen on Thursday confirmed the legal team for Cuomo and the district attorney's office will still have to appear for the court date. Cuomo is expected to be arraigned before the charge is expected to be formally dismissed. 

"Because a complaint has been filed and he must be arraigned on it – the fact that the DA will join in the application/motion by his attorney to have the charge dismissed/and will decline to prosecute the case will be part of the proceeding," Chalfen said in an email.

Cuomo is expected to appear virtually in court. 

Cuomo, who resigned in August, was initially charged in November by Albany County Sheriff Craig Apple following allegations by former aide Brittany Commisso that he groped her at the Executive Mansion in 2020.

Cuomo has denied the allegations. 

Soares this week announced that while he was "troubled by the allegations" there was not sufficient enough evidence to move forward with the case.
