A second lawsuit may be coming against the Town of DeWitt and Onondaga County from the owners of Shoppingtown Mall.

According to a town official, Moonbeam Capital Investments, LLC filed a notice of claim back in January.

It alleges that the town and county are trying to wrestle away ownership for a new, unnamed developer.

Moonbeam is also claiming that their redevelopment efforts have been hurt by the town.

Sam Gordon, the Director of Planning and Zoning, said that there’s a provision in the town code that won’t allow permits to be issued for a property that owes back taxes.

The mall owner has been in a legal battle with area lawmakers for several years over its owed back taxes. They currently owe more than $9 million.

Moonbeam first filed a lawsuit against the county back in October for the apparent move to try to take over the property. In December, County Executive Ryan McMahon gave a public scathing of Moonbeam in preparation for a possible second lawsuit.

There is no word yet on how long the company has to decide if they’ll follow through with a lawsuit.

Moonbeam is a developer with more than 50 properties in the country, 10 of which are malls. Many of those malls are facing similar dilemmas.
