HERKIMER, N.Y. -- A state supreme court rules in favor of Herkimer County's plan to build a new county jail on the former P and C site in Herkimer.

That means the proposed site is now exempt from zoning restrictions.

Herkimer County Legislature Chairman Bernard Peplinkski says the village has 30 days to decide if it will appeal the decision.

If it does, the matter will go to an appellate court, but Peplinkski hopes the two will be able to work something out.

He says they've considered other options, but the site's proximity to the courthouse is ideal. 

"We have looked at dozens of sites and some have been ruled out because of cost, the landscaping, the poor location, sewage, yeah there's so many different factors that have to be taken into consideration," Peplinkski said. 

The jail is expected to cost around $30 million.
