The former president of SUNY Upstate Medical University will avoid prison time for abusing his position for his own financial gain.

David R. Smith was sentenced Monday to three years of probation, and must pay more than $250,000 in restitution and fines.

The decision comes in exchange for a guilty plea to three counts of official misconduct.

An investigation by the New York State Inspector General found that Smith, who resigned in November 2013, used several funding streams under his control to improperly pad his personal income. 

The investigation revealed that Smith directed his subordinate to approve three unauthorized raises.

He also received than $300,000 via a pass-through arrangement with a pediatric group that was not properly authorized.

And he submitted, approved, collected and received unauthorized reimbursements of more than $187,000 for housing expenses above the authorized $5,000 a month.
