A man is dead after being shot by a New York state trooper during a confrontation in Hamilton County.

According to New York State Police, deputies were dispatched around 8:48 p.m. Tuesday to a single-family residence on Old Piseco Road in the Town of Arietta, in Hamilton County, for a person experiencing mental health issues.

When troopers arrived, they began interviewing the resident, Daniel E. Condon, 55. When Trooper Ryan Mousaw tried to transport him to the hospital for evaluation, Condon began to struggle with him.

Mousaw tried to deploy his Taser, but was unsuccessful. Condon subsequently struck Mousaw in the head with a hatchet, causing a laceration.

Police said Condon ignored verbal commands to drop the hatchet and Mousaw fired his postol, striking Condon.

Mousaw rendered first aid to Condon but was unable to resuscitate him.

When assistance arrived on the scene, Mousaw was transported to the hospital. He was treated for a head laceration and a sprained right arm and wrist. He has been released.
