The Town of Root may need to put a few extra chairs at its next board meeting, after a same-sex couple says they were denied a marriage license by the town clerk.

Dylan Toften says he and his partner were discriminated against by the town. He's calling for people to attend the meeting this Wednesday in opposition of the town clerk who he says denied them.

Toften has posted multiple times on Facebook about the alleged incident.

The clerk's office would not comment. However, a lawyer for the town says the pair was never refused. He says they simply didn't make the appointment every couple is required to make.

Governor Andrew Cuomo has called for an investigation into what happened.
