The Mr. Ding-a-Ling ice cream truck driver charged with DWI is now out of a job.

The owner of Mr. Ding-A-Ling Ice Cream, Brian Collis confirms that 51-year-old Thomas Powers was fired this week.

Colonie police say they caught Powers swerving on Watervliet Shaker Road Monday.

When officers stopped his truck, they said Powers was slurring his words and smelled of alcohol.

He was charged with aggravated DWI.

Collis says Mr. Ding-A-Ling drivers are seasonal contractors. Every April, each driver goes through a background check from the National Association of Ice Cream Vendors. It certifies their driver's license and criminal record.

According to Collis, all of Powers' checks came back clean.

Powers is due back in court next week.
