SCHOHARIE, N.Y. -- The judge in the Cal Harris murder trial ruled Wednesday that Harris' defense team could not mention a possible alternate suspect responsible for the September 2001 disappearance and presumed death of Harris' wife Michele.

The defense had been hoping to bring in testimony and evidence about Stacy Stewart, however the judge ruled Kevin Tubbs, a defense witness, could identify Stewart.

Tubbs originally testified he saw Michele Harris arguing with a man in her driveway in the early morning hours the day after the prosecution claims Cal killed her. That testimony formed the basis for Harris' original appeal following his 2007 conviction.

Meanwhile, Stewart's ex-girlfriend will not be allowed on the stand because her testimony would be hearsay.

The jury was not in the courtroom all day as lawyers presented their arguments and the judge heard testimony from Harris' private investigator.
