With the new mask mandate, some Republicans in the Erie County Legislature are asking for a new state law to revoke the county executive’s powers.

Legislators Joe Lorigo, Chris Greene, Frank Todaro and John Mills are spearheading the resolution. It would call on New York state to terminate all emergency orders declared by Erie County Executive Mark Poloncarz.

The resolution argues the power to issue mandates was meant to be a temporary measure granted to Poloncarz by the start of the COVID-19 pandemic.

The legislators argue those powers are no longer necessary.
