ORCHARD PARK, N.Y. — A gym owner in Orchard Park just got another win in state court.

On Tuesday, a judge ruled that Athletes Unleashed no longer needs to follow restrictions from executive orders that are older than 30 days.

The judge says New York Executive Law 29a — the law used to authorize the governor’s COVID-19 executive orders — places a 30-day limit on the directives, unless they’re extended.

This however does not include the 11 p.m. curfew which was recently issued this February.

Gym owner Robby Dinero made national headlines last year after video of a gathering at his gym went viral when the crowd rejected a county health inspector’s attempt to end the meeting.

Dinero then ripped up a $15,000 fine live on Fox News and vowed to open his facility even though at the time orange zone restrictions required it be fully closed.

The case first made progress back in December, when the New York State Supreme Court ruled in favor of Athletes Unleashed by issuing a temporary injunction on the 25 percent capacity limit.

“It's a huge victory for our client,” said attorney Todd Aldinger. “The state has really been fighting this hard and they've tried to bring counter claims against him, I think trying to make an example out of him and I think this is a huge win for him. He can now teach a class size that will allow him to stay in business.”

Athletes Unleashed will be able to operate similar to how they were prior to the pandemic. The gym will still need to follow the Department of Health’s order on mask wearing and social distancing.

This only applies to Athletes Unleashed as it brought the claim on its own.

A Cuomo administration spokesperson released a statement to Spectrum News, saying:

"We are reviewing this decision, which applies only to this business, and are considering all options.”
