Kenneth Achtyl, the Erie County deputy convicted last week of assault for hitting a Bills fan outside a game in 2017, has resigned.

The Erie County Sheriff’s Office confirms that Achtyl turned in a letter of resignation during his trial.

Achtyl was on paid administrative leave following notification of an investigation into the events of December 3, 2017.

Nicholas Belsito and friends were tailgating in the Bills bus lot before the game on December 3, 2017. Body camera video and cell phone pictures show some of what happened that day.

After a friend was arrested, Belsito approached Achtyl and his partner’s vehicle to find out where they were taking him. After a brief conversation, Belsito walked away and swore at Achtyl. The deputy left the car and grabbed Belsito, who suffered a concussion and broken nose during his arrest.

Achtyl is one of three deputies being sued for assault and battery after an East Otto man says they beat him up during a traffic stop.
