Three people are dead, including a 4-year-old girl, following a crash in Wyoming County.
It happened on Route 20A at Maxon Road in the town of Sheldon around 6:30 a.m. on Sunday.
According to the Wayne County Sheriff's Office, a New Jersey family of nine was headed westbound to Niagara Falls, on Route 20A, in an SUV. That's when a southbound pickup truck on Maxon Road drove through a stop sign at the intersection and hit the SUV.
The southbound driver Richard Sawicki, 20, of Lackawanna, New York was taken to a Buffalo area hospital. He has since been released.
Sawicki is charged with aggravated vehicular homicide, driving while intoxicated, and reckless driving.
The sheriff's office says an adult man, three adult women, and five children— ages 14, 10, 4, 4, and 4— were in the SUV at the time.
Ondina Castro De La Cruz, 47, and Mayelin Brito-Castro, 32, were ejected from the car and pronounced dead at the scene, according to the office. The 4-year-old girl, who has not been identified, was transported to the hospital for head injuries, but died an hour later.
Reyes Rodriguez, 55, and Maria Brito-Castro, 26, were both treated at a hospital and have since been released. The other three children remain hospitalized.
Deputies say everyone was not wearing a seat belt and no car seats were in the vehicle.
Sawicki is being held in the Wyoming County Jail. His driver’s license has also been suspended. He's due back in court on June 10.
The incident remains under investigation. Deputies say additional charges are expected.
