The former operators of the Emerald South Nursing and Rehabilitation Center have filed a notice of claim against Erie County Executive Mark Poloncarz.

The former operators claim Poloncarz made false and defamatory statements about them and their business.

They also claim Poloncarz maligned them during a press conference in August, and continued to malign them on Twitter during August and September of this year.

The state health department appointed a receiver to oversee operations at the troubled nursing home in October.

The receiver later announced it was closing the facility.

Erie County’s executive office released this response:

“While we will not comment on the factual or legal aspects of the pending litigation, the county stands ready to fully defend against this frivolous lawsuit. Additionally, County Executive Poloncarz and the Department of Senior Services are extremely pleased to see that action has been taken by New York State to resolve the serious issues that have plagued Emerald South Rehabilitation and Care Center.”
