Erie County's top prosecutor confirms the state attorney general will not investigate the death of a man in an officer-involved shooting in Black Rock.
District Attorney John Flynn said the victim, 47-year-old Marcus Neal, had a weapon when he was shot.
The attorney general’s office only investigates incidents when officers shoot unarmed individuals.
Police said Neal was armed with a knife when he was shot by Buffalo Police Lieutenant Joseph Meli on Gladstone Street late Tuesday night after a mile-long foot chase.
The department said Neal charged at officers with a knife, prompting Meli to shoot him.
Meli is currently on administrative leave, as is standard in a case like this.
The incident is still under investigation by Flynn's office.
