The Buffalo Police officer who hit a woman while she crossed Hertel Avenue last week was not using his lights and sirens.

Captain Jeff Rinaldo confirmed Thursday morning that the officer was responding to a call for service, but not an emergency, on March 30 when he hit 64-year-old Susan LoTempio. She was out for her morning walk.

The officer was not required to use the lights and sirens, Rinaldo said.

"I don't — wouldn't wanna say that that's what led to the woman's death. I would say that as part of our investigation, we look at the response to any call for service and whether it fell within our policy,” he said. “At this point, we do not believe that speed was a factor but again we're waiting on the final accident reconstruction from the state police."

Buffalo police have handed over the case to state police to conduct an independent investigation.
