CICERO, N.Y. -- The man who fired a gun during a road rage incident in December will serve one year conditional discharge. 

49-year-old Mark Miller was sentenced in Cicero Town Court Tuesday night.

He pleaded guilty Monday to second-degree reckless endangerment. 

Miller was involved in an incident on Circle Drive in the Town of Cicero, where another driver, 42-year-old Robbert Tifft, approached his car and opened the passenger door after Miller cut him off.

Miller told police he pulled out a gun to warn Tifft before it discharged.

His attorney says this is a special case. 

"There's no labels in this case to who the defendant is and who the victim is," said Rome Canzano, Defense Attorney. "The aggressor in this case, we can all agree, was not Mr. Miller. He was the victim of this. He had been attacked three times prior to the gun going off and fled the scene thereafter." 

As part of the deal, Miller is forced surrender his pistol permit and handguns.
