Danielle Gardiner's car was left totaled Friday night after a drunk-driver crashed into it.
Her son-in-law was behind the wheel at the time, traveling near the intersection of Prospect Street and Downs Avenue in Binghamton.
When deputies arrived, they arrested 35-year-old Jim Worhach, the spokesman for Broome County's District Attorney's Office for driving while intoxicated.
Investigators said his blood alcohol level was .28, more than three times the legal limit.
"My son-in-law, he's terrified. He's terrified to get back in the car. He was doing a responsible thing as a 19 year old, going to work, and then this happened," said Gardiner.
Worhach, who is also the president of the Children's Charity of Greater Binghamton, now faces felony DWI charges for the second time in six years.
He was convicted back in 2014 while working under then County Executive Debbie Preston.
Gardiner said she wants an explanation, and a face-to-face apology.
"My son-in-law didn't ask for this, and I dont want to be watching the news and see it happen to somebody else, and possibly my son-in-law could have died from this. I dont want it to happen to anybody else," said Gardiner.
Gardiner said she won't walk away until she feels justice is served.
