The public is invited to comment on a no further action remedy proposed by the New York State Department of Environmental Conservation (NYSDEC) related to the Former Atlantic Fuels Marketing Corporation (AFMC) Facility site (“site”) located at Ambrose Street, Sackets Harbor Village, Jefferson County. Please see the map for the site location.

The cleanup activities were performed by Village of Sackets Harbor with oversight provided by NYSDEC.
How to Comment
NYSDEC is accepting written comments about the proposed remedial action plan for 45 days, from November 18, 2016 through January 2, 2017. The proposed plan is available for review at the location(s) identified below under "Where to Find Information."

Proposed Remedial Action Plan
Based on the results of the investigation at the site and the Interim Remedial Measure (IRM) that was performed, the Department is proposing No Further Action as the remedy for the site. During the IRM, contaminated soil was excavated and treated above ground using a soil turning process to aerate the soil and enhance biological treatment of the contaminants. Following treatment the soil was tested and then used to backfill the excavation. The Department believes that the work conducted to date has successfully remediated the site and that this remedy is protective of human health and the environment. The site has been cleaned up to a level that allows residential use.
Summary of the Investigation
Based upon the investigations conducted to date the primary contaminants of concern at the site included volatile organic compounds (VOCs) and semi-volatile organic compounds (SVOCs). These compounds were related to the past use and release of petroleum products from petroleum bulk storage tanks and piping that contained petroleum products.
NYSDEC developed the proposed remedy after reviewing the detailed investigation of the site and the recommendation for No Further Action by the Village of Sackets Harbor.
Institutional and Engineering Controls
Institutional controls and engineering controls generally are designed to reduce or eliminate exposure to contaminants of concern. An institutional control is a non-physical restriction on use of the site, such as a deed restriction, when contamination left over after the cleanup action makes the site suitable for some, but not all uses. An engineering control is a physical barrier or method to manage contamination such as a cap or vapor barrier.

Next Steps
NYSDEC will consider public comments as it finalizes the no further action remedy for the site. The selected remedy will be described in a document called a "Record of Decision" that will explain why the remedy was selected and respond to public comments.
Background
Location: The Former AFMC (Atlantic Fuels Marketing Corporation) Terminal Site is located on the western edge of the Village of Sackets Harbor. The site is divided into two parcels by Ambrose Street. The site is approximately ¼ mile south of Black River Bay which is along the eastern shore of Lake Ontario.
Site Features: The site is relatively flat and all preexisting structures have been razed except for one storage building located on the north terminal. A wetland is located on the north side of Ambrose Street to the west. The two parcels are surrounded by a six foot chain link fence.
Current Zoning: The site is currently zoned for industrial uses. North of the site is the Sackets Harbor Battlefield where British and Canadian soldiers confronted American Militia and Regular United States Army during the war of 1812. Residential properties lie to the east in the Village of Sackets Harbor. South of the site is a forested area, while west of the site are agricultural lands.
Past Uses of the Site: The site was used for agricultural purposes until the 1920s when a petroleum bulk storage facility was installed by Mobil Oil Corporation. During World War II, the site was expanded to include tanks on the northern side of Ambrose Street. At the same time an underground pipeline was installed to transfer fuel from barges in Black River Bay to the site. Petroleum storage activities continued at the site until 1988. In 1989 the petroleum storage tanks were dismantled and removed from the site.
Site Geology and Hydrogeology: The limestone bedrock varies in depth from 3 to 9 feet below the ground surface and slopes generally north toward Lake Ontario. The overburden is comprised of silts and clays with a discontinuous layer of dense glacial till immediately above the bedrock. Perched overburden groundwater is present seasonally from 6 - 6.5’ below grade. Bedrock groundwater is present from 6-8 feet below grade and is presumed to flow in a northerly direction, toward Lake Ontario.
Environmental Restoration Program:
New York's Environmental Restoration Program (ERP) reimburses municipalities for their costs to investigate and clean up municipality owned contaminated properties. Once cleaned up, the properties may be redeveloped for commercial, industrial, residential or public use.
A brownfield is any real property that is difficult to reuse or redevelop because of the presence or potential presence of contamination.
