BUFFALO, N.Y. -- Kiarre Harris still hasn't gotten her children back more than one month after Child Protective Services took them away.

Harris was charged with educational neglect after she pulled her kids out of a Buffalo Public School to be homeschooled.

"At this point, I just want my children back and I believe that my family and myself have been victims of racial discrimination," said Harris. 

She has filed complaints with both the Department of Justice and the Department of Education, asking for an investigation into whether or not her kids were taken because of her race.

"Do an investigation to determine whether she's being treated differently than other people similarly situated," said District Parent Coordinating Council President Sam Radford. 

Harris claims she filed the paperwork to homeschool her kids before she was arrested.

The District Parent Coordinating Council wants to know why that document wasn't processed.

"Ms. Harris did exactly what she was supposed to do and it's becoming socially acceptable to assume she must have done something wrong in light of the fact that you haven't rationalized what happened with the document once it was turned in," said Franklin Redd, of the DPCC Committee on Home Schooling.

Radford says even if the document wasn't processed in time, taking Harris' kids was an overreaction.

"You could have helped her if she didn't do it right. Or if there was a problem, offer her the help she needs," said Radford. 

He says the complaints could reveal racial bias by Child Protective Services through an investigation.

But in the meantime, he hopes they will help reunite Harris with her children.

"The only goal that we collectively have is for her to get her children back. Everything else can be worked out, but at this point, she still doesn't have her children back," said Radford. 

"The children are depressed, they miss me a lot, they miss being home and they're traumatized," said Harris. 

She says her children are in the care of other family and are attending school outside of the district.

Harris is scheduled to appear in family court on March 15.
