CHAUTAUQUA COUNTY, N.Y. -- The Chautauqua County Sheriff anticpates several charges will be filed against the driver of a car that crashed Saturday night in North Harmony, killing the man sitting in the passenger's seat.
Darrin Power of Elma died at the scene. He was 23.
The driver, Patrick Grimm, 24, of Ashville was treated at WCA Hospital in Jamestown and later released
"This is the kind of crash we used to have a lot more of, it was very horrific," said Sheriff Joe Gerace, D-Chautauqua County.
Gerace says a Porsche 911 hit several trees, before pieces of the car he was driving on Butts Road became scattered all over the roadway and in the woods.
At this point, no arrest has been made.
"We believe alcohol was a factor in this crash. A high-speed crash, I can't remember seeing one quite like this before in my career," said Gerace.
"I think it's premature to label it as anything, obviously it's an accident. We have to wait to see what sort of blood test result we have," said District Attorney David Foley, R-Chautauqua County.
Foley is reviewing the case as a possible vehicular manslaughter, and could likely present it to a grand jury. Foley says the severity of the charge will be determined based on whether Grimm's blood alcohol content was higher than the legal limit.
"It's a serious situation, it's a dangerous situation, we may end up getting results back that are below and then you're not within that realm of vehicular manslaughter at all, so I don't want to say that we have that, because we just don't know yet," said Foley.
Foley says he hopes to have those test results within the coming weeks.
