An Austin judge has ordered a convicted cop killer to undergo a mental evaluation after he waived his appeals and asked to move up his execution date.

Brandon Daniel, 27, shot and killed senior Austin police officer Jaime Padron at a North Austin Walmart in 2012. A jury convicted Daniel in February of last year and sentenced him to death.

This year, Daniel wrote a letter to the judge saying he wants to die. Friday morning, he appeared in court, where District Judge Brenda Kennedy told him he looks competent, but she wants a psychiatrist to test him out of an abundance of caution.

Prosecutor Gary Cobb, who tried the murder case, also said Daniel appeared competent to him.

"Being an extremely intelligent person, he's made the decision that rather than spend the rest of his life living with the consequences of what he's done, he’d rather suffer the consequences of what he's done,” Cobb said.

Cobb said the Padron family is fine with Daniel's wish to speed up his execution, but even if the judge allows him to waive his appeals, he still probably wouldn’t be executed for at least two more years.
