DURHAM, N.C. -- A Durham man is fighting for his life after a car hit him and drove away during the weekend. However, no one has been charged in the incident.

  • 59-year-old Tommy Chance is hospitalized in critical condition at Duke University Medical Center in Durham.
  • Durham Police say a driver hit Chance on Alston Avenue (NC 55) adjacent to the Holloway Street (NC 98/US 70 Business) intersection around 7 a.m. on Saturday.
  • The driver left the scene, but returned hours later in a different car and told police he believed he hit a deer.

59-year-old Tommy Chance is hospitalized in critical condition at Duke University Medical Center in Durham.

"Why do you want to run and hit a person and not feel sorry for it?" said Sharlene Carmon, Chance's wife. "No apologies, nothing. It's not right."

Durham Police say a driver hit Chance on Alston Avenue (NC 55) adjacent to the Holloway Street (NC 98/US 70 Business) intersection around 7 a.m. on Saturday. The driver left the scene, but returned hours later in a different car and told police he believed he hit a deer.

Camron hopes authorities eventually file criminal charges because of the damage the accident has already done to Chance and their family.

"We're crying, not sleeping, not eating," said Camron. "We have to spend our Christmas up here at the hospital. I just want justice served."

Durham Police are still investigating the crash.
