ROBESON COUNTY, N.C. – The man charged in the death of 13-year-old Hania Aguilar is expected to make his first appearance in court Monday.

Michael Ray McLellan, 34, faces ten charges, including first-degree murder, kidnapping, and rape.

Aguilar was forced into a family member’s SUV at the Rosewood Mobile Home Park on November 5.

The SUV was found abandoned in a wooded area three days later.

Her body was recovered three weeks later.

She was laid to rest Saturday, the same day McLellan was officially charged.

Authorities say McLellan’s DNA was found in the SUV.

McLellan was already in jail for a previous charge when he was charged with Aguilar’s murder. That crime was committed in Fairmont in October.

The district attorney says he served his time and went back onto the streets with Hania being his next victim.

Officials say they believe the day the teen was kidnapped is the same day she was killed.

McLellan could face even more charges as the case progresses. He's due back in court December 21.

This is a developing story that will be updated as information comes in.
