BUFFALO, N.U. -- The second man charged in the boating death of a Lockport teenager will learn his fate this week as Timothy Wisniewski will be sentenced Thursday morning in Erie County Court.

Wisniewski was the owner of a boat involved in a fatal incident and he was also under the influence, along with the teens on the boat who were out for a ride. 

In June of 2015, Wisniewski and the teenagers were boating down Ellicott Creek in the town of Tonawanda, when they went under a footbridge. 

Avery Gardner, 16, hit her head and died.

A jury convicted Wisniewski of criminally negligent homicide, two counts of operating a vessel while under the influence of alcohol, endangering the welfare of a child and unlawful possession of marijuana. 

The 51-year-old faces up to four years in prison. 

Gregory Green, 18, who admitted to driving the boat, was sentenced last Tuesday to six months behind bars. Green's lawyer says his mother places most of the blame on Wisniewski. 

After this incident, it came to light that Wisniewski was involved in another fatal boating accident dating back to the mid 1980's. According to Tonawanda police, Wisniewski was driving a boat along the canal when he hit a wall and one of his passengers fell into the water. 

Police say a dive team later found that man's body. 

Wisniewski told police he was scared, and that's why he never reported the incident. 

He never faced any charges.

Wisniewski will be back in Erie County Court Thursday at 9:30 a.m.
