SAN ANTONIO — Federal prosecutors will determine the sentencing for ex-lawmaker Carlos Uresti on Tuesday. A day ahead, the former senator is asking for the court for leniency. 

The sentencing memorandum was filed Monday on Uresti’s behalf. Uresti, who recently resigned from his position and prompted a special election, is seeking a lesser sentence, given his years of public service.

“Despite his fall from grace after the conduct involved here, this Court should nevertheless accept as true, that the overwhelming portion of the life of Carlos Uresti did not involve criminal conduct. His life has been devoted to helping others, and to making this state a better place for all Texans. The good and just outcomes that he accomplished for his community should stand as a significant mitigating force in the consideration of his ultimate sentence,” the memorandum says.

Uresti’s sentencing on 11 felony charges is scheduled for Tuesday.

Included in the memorandum are letters on Uresti’s behalf to the court, including Bexar County District Attorney Nico LaHood:

“I contemplated what to ask you to consider in your deliberation over the final sentencing of Mr. Carlos Uresti,” LaHood wrote. “After much thought and prayer, service came to mind. Carlos Uresti has exemplified service in his passion to protect the most vulnerable members of our community in Bexar County and throughout Texas.”

In February, Uresti was found guilty of 11 counts of fraud in what prosecutors called a Ponzi scheme tied to an oil and gas company.

In April, a federal judge denied a new trial for Uresti. At the time, Uresti’s attorneys said they planned on appealing. Uresti wasn't up for re-election until 2020. 

Uresti is schedule to be sentenced on June 26. He faces the possibility of years in federal prison and millions in restitution
