AUSTIN, Texas — Travis County District Attorney Margaret Moore released a statement saying her office will not prosecute an Austin police officer who was involved in a December officer-invovled shooting.

On Dec. 15, 2017, officer Alfredo Delvalle responded to a call at an apartment complex, located in the 5000 block of Lynnwood Street, from 43-year-old Andrea Faye Lindsey stating she had been stabbed and was bleeding heavily.

When Delvalle arrived he found Aubrey Quentin Garrett, 50, pacing at the front door of the apartment with a knife in hand. The officer took out his gun and gave Garrett loud verbal commands to drop the knife.

Police said Garrett ignored the officer’s commands, tossed patio furniture and continued attacking the victim. Delvalle then shot Garrett in defense of Lindsey. She was pronounced dead at the scene.

Garrett is charged with murder and his case is pending in felony court.
