KYLE, Texas — A Kyle man facing an aggravated assault with a deadly weapon charge after police say he hit someone with his car and then threatened them with a gun.

This happened Sunday night in a cul-de-sac on the 300 block of Thicket Lane.

According to police, a witness saw Daniel Zachary Gutierrez, 28, pacing around his vehicle and screaming, taking a handgun from the trunk and putting it in his waistband.

Someone then went up to Gutierrez asking if he was okay. Gutierrez yelled at the person, who then tried to leave, but Gutierrez blocked the way with his car.

Police say that's when Gutierrez hit the person with his car, got out, threatened him with the gun and then drove away.

Kyle officers located Gutierrez who then pulled over and fled on foot in area of Bunny Trail and Llama Loop, according to the release.

At some point, officers lost visual of the suspect, according to the release. After an extensive check of the area, Gutierrez could not be located.

However, Kyle Police’s investigation into the case led them to Gutierrez, who was arrested at his home without incident.

Gutierrez was also booked on charges of obstructing a highway and reckless driving, both Class-B misdemeanors. Bond has not been set at this time.
