AUSTIN, Texas — Two Austin police officers have been indicted on charges related to a shooting that happened on Feb. 16, and another has been indicted that happened in 2017. 

According to the indictments, Donald Petraitis has been charged with official oppression and assault causing bodily injury. Robert Pfaff is charged with official oppression, assault causing bodily injury, abuse of official capacity and aggravated perjury.

A man in his 30s was shot near Red River and 12th St. on the night of Feb. 16. He was taken to the hospital with non life-threatening injuries, but as first responders arrived, the shot man was surrounded by a group of people.

Pfaff and Petraitis are accused of injuring a man at the scene with a stun gun. Pfaff's other charges stem from the same man claiming that Pfaff lied about him not following police commands after being stunned.

Interim Police Chief Brian Manley said that the indictment comes from inconsistancies between the officers' written reports about the use of force and camera footage. 

Attorneys for Pfaff and Petraitis released a statement saying that the two officers' "actions were necessary, appropriate, and consistent with APD training" and "The District Attorney’s Office believes the Taser deployment was a criminal act, and believes a discrepancy exists between an officer’s body camera footage of the incident and the independent recollections of the officers."

Nathaniel Stallings has been charged with assault causing bodily injury relating to a seperate case from Oct. 6.  Stallings is being charged with grabbing a woman while trying to make an arrest, which caused her to hit her head on the hood of an automobile.

APD said that they will not release and body cam or dash cam video relating to these two cases.

Asides from the court cases, the officers will have administrative hearings.
