UPDATE: On Thursday, Terry Allen Miles' lawyer confirmed that they waived the preliminary and detention hearings set for this morning.

AUSTIN, Texas — The man arrested earlier this month in Colorado for the kidnapping of two Round Rock children has his first Texas hearing set. 

Terry Allen Miles, 44, is scheduled for a detention hearing and a preliminary hearing at the same time, on Thursday Jan. 25, starting at 10:30 a.m. at the United States Courthouse, 501 West Fifth Street, Austin, Texas. 

Miles was extradited to Texas last Thursday, Jan. 18, according to the U.S. Marshals Service. 

He was arrested Jan. 3 by the Las Animas County Sheriff’s Department in La Veta, Colorado. Miles had been sought on a federal complaint for the kidnapping of two girls*, ages 7 and 14, both of whom were found safe at the time of the arrest.

Miles made his initial appearance Jan. 4 in the U.S. District Court in Denver and was remanded to the custody of the U.S. Marshals Service, awaiting extradition back to Texas.

Miles was received Thursday by the U.S. Marshals Service in the Western District of Texas, Austin Division, where he will remain in custody and proceed through the judiciary process on the federal charge of kidnapping. A court date has not been set.

The search intially began after Round Rock police were called out to a home in the 2600 block of Leslie Court on to do a welfare check on Jan. 1. Police found the body of 44-year-old Tonya Bates, the girls' mother, in the home.

Miles was named as a person on interest in Bates' death and was initially believed to have taken the girls. He was also Bates' roommate. 

A lieutenant at the Calcisieu Parish Sheriff’s Office in Louisiana confirmed that Miles had an extensive criminal history in Louisiana, and that some of the charges included domestic violence, burglary, DWI and battery.  

The investigation into the girls' abduction and Bates' death is ongoing.
